It is a very interesting novel about the rights of novel of Jammu & Kashmir before lifting of special status from there. By virtue of provisions of “ The constitution (Application to Jammu & Kashmir) Order, 1954, Ruhani, a girl of Rajouri of Jammu would be deprived of her ancestral property and her issues would also be deprived of the same, if she would marry any guy like Jishan from other State(s).
The affairs between Ruhani, a doctor of Rajouri Govt hospital and Jishan, an IITian from West Bengal did not got a halt due to the said order of 1954. Ruhani didn’t give up her right(s). It is not only the issue of some property, but the matter of ‘Identity’ of the Kashmiri girls affected by this order.
The situation changed when on 05.08.2019, a notification/order was issued revoking the order of 1954. Now there is no legal obstacle to inherit the ancestral property by Ruhani. Will the bond of Ruhani and Jishan will continue —–?
